At Nuance Atelier, we believe in creating timeless leather goods designed for long-term use rather than disposable consumption. We carefully select materials that are intended to age gracefully and encourage responsible ownership rather than frequent replacement. We are committed to creating products designed to stand the test of time.

DEFINITIONS

• "Services" means our website, online store, products, digital content, customer support, applications, and any related services made available by Nuance Atelier.

• "Customer", "you", and "your" refer to any individual accessing, browsing, or purchasing through the Services.

• "Nuance Atelier", "Nuance", "we", "our", and "us" refer to the brand, online platform, and business operations managed under the sole proprietorship of Cem Berkay Yıldız, who holds all lawful rights to the registered trademark "NUANCE" (Classes 18 & 25).

1.3 Account Security

You are solely responsible for maintaining the confidentiality and security of your account credentials. You agree to notify us immediately at info@nuanceatelier.com of any unauthorised access to, breach of security, or use of your account.

SECTION 2 - OUR PRODUCTS, MATERIAL NATURE, AND AVAILABILITY

2.1 Natural Material Variations

Our products are crafted from carefully selected genuine leather. Due to the natural characteristics of leather, slight variations in colour tones, grain marks, pores, and texture unevenness may occur. These are not defects but proof of the authenticity and unique nature of genuine leather. Each leather hide is unique; therefore, no two products will be identical.

2.2 Product Images

Actual product colours may vary slightly depending on individual display settings and lighting conditions. Such minor variations shall not be considered manufacturing defects.

2.3 Patina Development

The development of a natural patina over time is an inherent and desirable characteristic of genuine leather, enhancing the individuality and character of each product.

2.4 Product Dimensions

All measurements provided on our website are approximate. Minor dimensional tolerances may occur as an expected part of the premium leather production.

2.5 Product Availability

Product availability is not guaranteed. In the event that a purchased item becomes unavailable post-purchase, we reserve the right to cancel the order and issue a full refund to your original payment method without any further obligation or liability.

2.6 Packaging & Modifications

Packaging materials may differ from website imagery depending on logistics and our ongoing sustainability initiatives. All product descriptions and prices may be updated from time to time without prior notice.

SECTION 3 - PRODUCT WARRANTY & LEATHER CARE

3.1 Product Warranty

Nuance Atelier warrants that its products will be free from material manufacturing defects at the time of delivery. This warranty does not cover normal wear and tear, accidental damage, misuse, improper storage, exposure to water or harsh chemicals, or the natural ageing and patina development of genuine leather. This warranty is provided in addition to, and does not replace, any mandatory consumer rights available under applicable law. Except as expressly stated herein, no additional warranties, whether express or implied, are provided.

3.2 Leather Care Responsibilities

Customers are responsible for following the specific leather care recommendations published by Nuance Atelier. Failure to maintain products in accordance with our care instructions may affect the validity of warranty claims where improper care has contributed to the reported issue.

SECTION 4 - ORDERS AND CANCELLATIONS

4.1 Order Acceptance

When you place an order, you are making an offer to purchase. Orders are accepted and processed only after successful payment authorisation and subsequent order confirmation by Nuance Atelier.

4.2 Right to Refuse or Cancel

We reserve the right to accept, decline, or cancel any order where pricing errors, stock discrepancies, suspected fraud, or violations of these Terms are identified. We further reserve the right to limit the quantities of products purchased per person, per household, or per order at our sole discretion.

4.3 Right to Refuse Service

We reserve the right to refuse service to anyone for legitimate business reasons and to the extent permitted by applicable law.

4.4 Governing Policies

Your purchases are subject to return or exchange strictly in accordance with our separate Refund & Return Policy. You represent and warrant that your purchases are for your own personal use and not for commercial resale or unauthorised export.

SECTION 5 - PROMOTIONAL CODES & GIFT CARDS

5.1 Promotional Codes

From time to time, we may offer discount or promotional codes. Unless explicitly stated otherwise, these codes are strictly single-use per customer, cannot be combined with other active campaigns or offers, and cannot be redeemed for cash. Promotional codes have no cash value and may not be transferred, resold, or reproduced. We reserve the right to cancel any promotional code at any time if we suspect misuse or abuse.

5.2 Gift Cards

Any gift cards purchased or issued through our store are non-refundable and cannot be exchanged for cash, except where required by applicable local law.

SECTION 6 - PRICES, BILLING, AND OBVIOUS ERRORS

6.1 Obvious Errors

Obvious pricing errors do not bind Nuance Atelier. In the event of a manifest or typographical error where a product is listed at an incorrect price, we reserve the right to cancel any orders placed for that item, even after an initial confirmation.

6.2 Domestic Orders (Republic of Türkiye)

Prices for shipments within the Republic of Türkiye include applicable Value Added Tax (VAT).

6.3 International Orders & Customs

Prices posted in our online store do not include destination country customs duties, import taxes, local consumption taxes, or customs clearance fees. All such fees are the sole responsibility of the buyer. Nuance Atelier is not liable for packages abandoned, destroyed, or delayed due to unpaid customs fees or customs processing.

SECTION 7 - SHIPPING, DELIVERY, AND RISK OF LOSS

7.1 Delivery Estimates

All delivery timelines and dates are estimates and shall not be construed as guaranteed delivery commitments. For detailed information on shipping rates, timelines, and carrier procedures, please refer to our separate Shipping Policy.

7.2 Customer Responsibility

Customers are solely responsible for providing accurate and complete shipping information. Nuance Atelier shall not be held responsible for shipping delays, delivery failures, or losses resulting from incorrect addresses supplied by the customer.

7.3 Transfer of Risk

Once we transfer international shipments to the carrier (e.g., DHL, FedEx, UPS), the title and risk of loss pass to you, unless otherwise required by applicable consumer protection laws or expressly agreed in writing.

SECTION 8 - INTELLECTUAL PROPERTY

8.1 Ownership of Content

Our Services, including all brand names, logos, product designs, text, layout, and graphics, are owned exclusively by Nuance Atelier and are protected by applicable intellectual property laws. This includes all product photography, lifestyle imagery, videos, product descriptions, icons, graphics, website design, metadata, and brand identity.

8.2 Licence Restrictions

No licence or right is granted to use any trademark, logo, or trade dress without prior written permission. Nothing contained within the Services shall be interpreted as granting, by implication, estoppel, or otherwise, any licence or right to use any intellectual property without our prior written consent. All goodwill arising from the use of our intellectual property shall remain exclusively vested in Nuance Atelier. Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law. Statutory product warranty rights for consumers under local law remain unaffected.

SECTION 14 - FORCE MAJEURE

Nuance Atelier shall not be liable for any delays or failures in performance caused by events beyond its reasonable control. Such events include, but are not limited to, natural disasters, pandemics, public health crises, governmental actions, customs delays, transportation interruptions, supplier failures, infrastructure breakdowns, labour disputes, cyberattacks, or severe communication network failures.

SECTION 15 - GOVERNING LAW AND JURISDICTION

These Terms of Service and any separate agreements shall be governed by and construed in accordance with the laws of the Republic of Türkiye. Any disputes arising from these Terms or purchases made through the Services shall be subject to the exclusive jurisdiction of the Consumer Arbitration Committees (within legal monetary limits) and the Istanbul (Bakırköy) Courts and Execution Offices. Nothing in this Section limits any mandatory rights granted to consumers under applicable local consumer laws.

In the event these Terms of Service are translated into another language for local convenience, the English version shall prevail to the extent permitted by applicable law in the event of any inconsistency, ambiguity, or conflict in interpretation.
